Clarke: Jeff**,** let’s talk about personal injury claims. What is a personal injury claim?

Jeff: That’s when someone’s been hurt, maybe in a car wreck, maybe from a dog bite, maybe in a work accident by the negligence or wrongdoing of somebody else.Clarke: And so, the important thing about personal injury claims is they need to have, we need to be able to establish liability: it was somebody else’s fault; damages: a person was hurt; and coverage: there’s a source of recovery.

Jeff: Yeah, finding coverage is really important. You can have somebody else at fault, you can be injured, but if there’s nothing to secure for that, that’s bad. Like, we want to make sure we’re looking at the assets of whoever caused this harm. We have an investigative team that will look into those things. We’re trying to find all the insurance policies that we can, that we can sometimes stack on top of each other. That’s something that not all law firms know how to do effectively.

Clarke: Well, that brings me to my next question: what should a person look for in a personal injury law firm?

Jeff: You want experience. You want somebody who understands what they’re doing. All of our lawyers on our trial team have done insurance defense work, represented the insurance companies, or been claims adjusters for many, many years. And they have now moved over to representing people who are injured. So they know what the insurance companies are thinking, they know what they’re going to ask, they know their tricks. And all of our lawyers are really good at building the value of these cases using our experienced professionals.

Clarke: And why is that important?

Jeff: Well, what we want to do is make sure we’re capturing all the damages. It’s easy to show somebody went to the doctor and got medically treated, but how has it affected them psychologically? How has it affected their work? How has it affected their home life? How has it affected their children? All of these things are difficult to capture, quantify, and monetize, and we can do that with our experienced professionals.

Clarke: Well, so our firm’s mission is to help people recover physically, financially, and emotionally after an accident. And so that’s why that’s so important to us: we want to help people physically by securing high-quality medical care that we can for them. We want to help them financially by maximizing the value of each claim. We want to help them emotionally by making sure that if they do have any mental health injuries as a result of this accident, we help get that treated, and we seek to include that in their settlement. So we want to have a very comprehensive approach to helping people recover after these kinds of accidents, personal injury accidents.

Clarke: Let me ask you this, Jeff, after an injury, after an accident, some people, you know, are thinking, “Should I call now or should I wait and see how it goes and then call?” What is your response to that?

Jeff: You want to call immediately because we have an investigative team that will go out and gather evidence, talk to witnesses, take pictures of the scene, look at the assets of whoever caused the harm, all of these different things. We want to involve our experienced professionals early. We want to involve all of our lawyers early on these cases so we can think through how we build the value of these cases.

Jeff: How do we take a $10,000 case and make it a $100,000 case, and a $100,000 case and make it a million-dollar case? All of those things happen from the very beginning. And if we’re not in early on it, then the insurance companies will be. They’ve got their teams of experienced professionals; they’ve got their lawyers working on these things early. And if you’re up against them all alone, that’s going to be a problem.

Clarke: I think that’s the key, that the insurance company is working on these cases right now. And so if you are not working on these cases right now, you are at a big disadvantage. And so if you have a personal injury claim, call us. Call us now, and you can talk to us, and we’ll get to work.

What constitutes a personal injury claim in North Carolina?

A personal injury claim arises when an individual sustains harm due to the negligence or wrongdoing of another party, such as in a car wreck, dog bite, or workplace accident. In North Carolina, however, the doctrine of contributory negligence means that a claimant who bears any degree of fault for the accident, even a small amount, may be completely barred from recovery. This makes establishing that the other party was solely at fault a particularly critical part of any North Carolina personal injury claim.

What are the essential components of an injury claim?

To pursue a personal injury claim successfully in North Carolina, a claimant must typically establish that the other party had a duty of care, that they breached that duty, that the breach proximately caused the injuries, and that measurable damages resulted. As a practical matter, identifying an available source of recovery, such as an insurance policy, is also important because a judgment is only as valuable as the defendant’s ability to pay.

Why is identifying insurance coverage so important?

Identifying coverage is critical because even if liability and damages are proven, there must be a source of insurance or assets available to facilitate a financial recovery.

What is insurance policy “stacking”?

Insurance stacking refers to combining coverage limits from multiple separate insurance policies to increase the total amount of coverage available for an injury claim. In North Carolina, stacking rules are complex and subject to specific statutory restrictions under N.C. Gen. Stat. § 20-279.21. Stacking multiple vehicles covered under a single policy is generally not permitted, while combining the highest limits from two or more separate policies may be allowed in certain circumstances. The rules governing stacking have changed significantly due to a 2024 North Carolina Supreme Court ruling in N.C. Farm Bureau v. Hebert and subsequent corrective legislation (Session Law 2024-29), making it essential to consult an attorney about whether stacking applies in a particular case.

What qualifications are important when choosing an injury firm?

It is beneficial to look for a firm whose trial team has significant experience working within the insurance industry as defense lawyers or claims adjusters.

How does a lawyer’s background in insurance defense help my case?

Lawyers with insurance defense experience understand how insurance companies think, the questions they ask, and the tactics they use to evaluate claims.

What types of damages can be included in a settlement?

Damages typically include medical expenses, psychological impacts, lost wages, and the negative effects an injury has on a person’s home life and family.

How is the financial value of an injury case built?

Case value is built from the beginning by using experienced professionals to capture and quantify all physical, emotional, and financial impacts of the accident.

Why should I seek mental health treatment after an accident?

Seeking mental health care ensures that any psychological injuries resulting from the accident are treated and properly documented for inclusion in a legal recovery.

Why is it necessary to contact a lawyer immediately after an injury?

Immediate contact allows a legal team to gather evidence, interview witnesses, and protect your interests before the insurance company’s investigative team can create a disadvantage.
